Indemnity and Release

You shall indemnify and hold harmless PSL, its subsidiaries, associates, consultants, contracted parties, etc., and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney’s fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any policy/document incorporated by reference or your violation of any laws, rules, regulations or the rights of a third party.
b. You hereby expressly release SHUBHA DESIGN STUDIO and/or its associates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of SHUBHA DESIGN STUDIO’s suppliers, fashion designers, vendors, courier companies or other parties and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise.

Force Majeure

Neither party will be held liable for any loss or failure to perform any obligation (other than your payment obligation where you are still receiving all or part of any products purchased under these Terms), due to events such as storms, tsunami, fire, floods, earthquake, outbreak of any contagious diseases, or any other acts of God or any governmental act or industrial dispute(s), strikes, labour unrest, civil commotion, riots, terrorist attack, war, poor environment/weather conditions, mechanical break-down, obstruction of any public or private road/highway, of any circumstances (other than insolvency of the party) beyond any party’s reasonable control (“Force Majeure event”).
Party affected by Force Majeure event shall as soon as reasonably possibly send a written notice to the other party of occurrence of Force Majeure event. If the Force Majeure event continues for more than 3 months from the date of placement of purchase order for any product(s), either party may cancel the purchase order immediately by giving the other party a written notice of the termination of contract.
In case of termination of contract/purchase order due to Force Majeure event , you further agree to make payment for the product(s) so delivered prior to occurrence or during the occurrence, if any of the Force Majeure event.

Governing Law and Jurisdiction

Terms and any policy shall be governed by and construed in accordance with the laws of Republic of India.
Any dispute or difference either in interpretation or otherwise, of any conditions of the Terms hereto, the same shall be referred to the courts in Mumbai, which shall have exclusive jurisdiction.

Infringement of intellectual Properties

The contents on the Website shall also contain information provided by SHUBHA DESIGN STUDIO’s suppliers, fashion designers, vendors or other parties whose merchandise PSL invites you to purchase. Generally SHUBHA DESIGN STUDIO tries to verify the information coming from its suppliers, vendors, fashion designers, etc. before publishing it on the Website. However on certain occasions, SHUBHA DESIGN STUDIO may have to take such information on face value and publish it without any further verification. Thus if any of the material is found to be objectionable or is found to have violated any intellectual property rights, the responsibility of this would be with SHUBHA DESIGN STUDIO’s suppliers, vendors, fashion designers, etc. who provide SHUBHA DESIGN STUDIO with information as well as merchandise.
SHUBHA DESIGN STUDIO respects the intellectual property rights of others and expects its users to do the same. Without prejudice to clause 16(b) above, you will be required to provide a valid phone number while placing an order with us. SHUBHA DESIGN STUDIO may communicate with you either by e-mail, short message services (SMS), phone calls or by posting notices on the Website or by any other mode of communication to fulfill your order. Thus for contractual purposes, you consent to receive communications including SMS, e-mail or phone calls from us with respect to your order or any offers or promotions.

You are requested to read our Terms and Conditions and other policies available on the Website in addition to this policy as the same are binding upon you before purchasing.

Conditions For Returns Or Exchange

SHUBHA DESIGN STUDIO has a simple and hassle free return and/or exchange policy for certain products purchased

The products must be returned to SDS within 2 weeks (fourteen days) from the date it is delivered to you.
Please check the list of non-returnable or non-exchangeable products at the end of the policy. SDS may update this list from time to time and without any prior intimation to you.
The product must be returned in its original condition along with the invoice, all labels, tags, authenticity cards, dust bags, designer boxes, hangers, freebies, if any and other packaging intact sold as a part of the product.
Any garment sought to be returned or exchanged, should be unworn or unwashed. Garments that are found to be worn or damaged or soiled will not be accepted for return or exchange.
Any footwear sought to be returned or exchanged, should be unused. Thus footwear worn for trial purposes must be done on a carpeted surface. Footwear with worn soles will not be accepted for return or exchange.
Products returned under this policy will be subject to quality testing/inspection.
If SDS accepts the product returned, you will be entitled to receive refunds by accounts transfer which may take 10 to 14 days after the refund is approved by SDS.
If SDS agrees to exchange the product returned,you can purchase any other merchandise with the same value or more but not less than the original purchase price which may also include the purchase of one or more item.
Notwithstanding anything contained in this policy, SDS reserves a right to reject any request for return and/or exchange of any products without giving any reasons for the same. In such cases, products will be sent back to the customer at the original shipping address.
Return or Exchange is subject to deductions of any benefits for example any discounts availed, shipping or delivery charges waiver, etc., if any.
Customized or special delivery orders cannot be returned/exchanged.

Returns Or Exchange Procedure

The returns procedure can also be initiated through the Website by following the below mentioned steps:

i If you made the purchase as a registered user, log in to your account to initiate the process.

ii If you made the purchase from the Website as a guest, please register on the Website using the same email address provided while purchasing the product so that your products appear in your order history. You can initiate the process of return only if the said product appears in your order history.

SDS will email a ‘Returns/Exchange Request Form’ for you to fill up and email back to SDS.
If you are not the actual purchaser but received the product from some SDS customer, (for example as gift), you will have to request the concerned SDS customer to initiate the return process.
Upon receiving a ‘Returns/Exchange Request Form’, SDS will generate a ticket number which will be shared with you. This ticket number must be used in all communication(s) with SDS

SDS will send you a confirmation upon receiving the products. Upon undertaking quality test and inspecting the product,SDS will inform you about its decision with respect to acceptance or rejection of the products within 3 (three) working days of receiving the product but in either way you will receive a call from our customer care executive.

Incorrect Products

For the purpose of this policy, the term ‘incorrect product’ means the product does not match the description or specification set out in the purchase order or Website with respect to colour, size, or material.
SDS takes utmost care to deliver the products as per your order. If incorrect product is delivered, you must notify us by sending an email to shubhadesignstudio.in@gmail.com / shubhadesignstudio1@gmail.com or Contact us at 9674024634/9831186408/7003118455 within 2 days i.e. 48 hours of receiving the product.

Miscellaneous

In case of a conflict in any terms of Returns and Exchange Policy, the decision of SHUBHA DESIGN STUDIO shall be final and concluding, and you irrevocably withdraw your right to make any claim or demur on this ground.
